Every care is taken to ensure that you have a
trouble-free and enjoyable holiday. However, acceptance of bookings is subject
to certain important legal considerations, which are set out clearly
below. The contracting parties are Deborah
Tootell trading as TRAVEL ALGARVE, herinafter referred to as TRAVEL ALGARVE on
the one hand, and all holiday-makers represented by the person who makes the
booking and to whom the invoice is sent on the other. Your booking is accepted by TRAVEL ALGARVE on the date which
appears on the confirmation invoice, and English law will apply to this
contract.
All bookings are subject
to a non-refundable deposit. IT IS
IMPORTANT to pay the balance on the date due, which is shown on the
confirmation invoice, not later than 10 weeks prior to departure. If you do not, cancellation charges as set
out in number 3 below, will be levied.
TRAVEL ALGARVE reserve the right to treat the booking as cancelled by
you if the balance has not been received 8 weeks prior to your departure.
A refundable breakage
deposit will be added to your account (on most villas and apartments) and any
damage exceeding the amount held by us in this respect will be invoiced
accordingly.
1. Amendments
If you wish to amend your
holiday booking APPLY IN WRITING and TRAVEL ALGARVE will try to help. An
amendment fee of 20 per amendment will be charged.
2. Holiday
Cancellation
If you find that you
cannot go on holiday, please write to TRAVEL ALGARVE. Cancellations can only be accepted in writing from the person who
made the booking, and such cancellation will be effective from the date it is
received by TRAVEL ALGARVE. If cancellation of a holiday is made the following
charges will apply:
- Not less than 10 weeks before departure - Loss of deposit
- Ten weeks but not less than six - 50%
- Six weeks but not less than three - 65%
- Three weeks but not less than two - 85%
- Less than two weeks - 100%
3. Holiday Arrangements
All arrangements are made
in the best interest of the clients and the utmost is done to ensure that you
have a comfortable and enjoyable holiday.
However, the right is reserved to alter or cancel any holiday
accommodation or arrangements if unforeseen circumstances make this necessary. Should this happen, every effort to offer suitable
alternative arrangements will be made, but if you reasonably find the
alternative arrangements unacceptable, any monies already paid by you will be
refunded promptly.
TRAVEL ALGARVE shall use
its best endeavours to ensure that all services and amenities are available,
and that any defects are corrected or repaired as quickly as possible after
TRAVEL ALGARVE is notified of them.
However, the following are beyond the control of TRAVEL ALGARVE:
unsuitable weather conditions, insect or animal life indigenous to the country,
lack or defect of services and amenities including water and electricity
supplies, drainage and sewage, road works and construction brought about by
unforeseen circumstances. However,
where we become aware of any works which may adversely affect your enjoyment of
your holiday to a significant extent, we will advise you as soon as it is
practically possible where there is time to do so before departure.
4. Travel Conditions
When you fly, the
conditions of the airline apply to you, these conditions, some of which limit
or exclude liability, are the subject of international agreements between
countries. Obviously, there can be
flight delays, but these are beyond the control of TRAVEL ALGARVE.
5. Complaints
If you do have any
problems or complaints with the property/hotel, please contact the House/Hotel
Manager immediately and any outstanding problems or complaints must be put in
writing to him/her immediately. If the
problem or complaint is not satisfactorily dealt with, please telephone TRAVEL
ALGARVE at the time to allow us the opportunity of solving it. If you move to other accommodation or take
any action relating to such problem or complaint without allowing sufficient
time for us to deal with the matter, all rights to compensation or refund will
be lost.
6. Independent
Travel Arrangements
Please note that any
travel arrangements booked with other agents/operators do not constitute part
of this contract and are not covered by TRAVEL ALGARVE.
7.Your
Price Includes
Villa/Apartment
accommodation includes maid service, utilities, crockery, utensils, bed linen,
towels (except beach towels) and weekly change of bed linen. Hotel
accommodation includes bed and breakfast, maid service, towels and bed linen
and weekly change of bed linen.
8. Accuracy of our details
All descriptions are
advertised in good faith and every care is taken to ensure their accuracy. Regrettably, errors do occasionally occur
and an advertised facility can be either modified or not available.
9.On-Line bookings
Bookings made through our
website are not secure until written confirmation has been sent to you (usually
within a 48 hour period). TRAVEL ALGARVE cannot be held responsible if your
chosen property has been booked and you have booked flights independently prior
to receiving our confirmation.
10. Over occupancy
Maximum occupancy in our
accommodation is shown on our website. This should not be exceeded unless
authorised by prior arrangement. Should you not comply with these terms TRAVEL
ALGARVE reserves the right to terminate your holiday immediately without any
liability to TRAVEL ALGARVE.
